Algemene Voorwaarden – The Radiant Renaissance

Artikel 1 – Definities

In deze algemene voorwaarden wordt verstaan onder:

• Ondernemer: The Radiant Renaissance, gevestigd te Schinkelkade 23 A-H, 1075VH, Amsterdam, ingeschreven bij de Kamer van Koophandel onder nummer 99211327.
• Consument: de natuurlijke persoon die niet handelt in de uitoefening van beroep of bedrijf.
• Webshop: de online winkel van ondernemer.
• Producten: alle fysieke beauty- en verzorgingsproducten die via de webshop worden verkocht.
• Overeenkomst: de overeenkomst op afstand tussen ondernemer en consument.

Artikel 3 – Toepasselijkheid

1. Deze algemene voorwaarden zijn van toepassing op elk aanbod van de ondernemer en op elke overeenkomst die via de webshop tot stand komt.
2. Afwijkingen van deze voorwaarden zijn alleen geldig indien schriftelijk overeengekomen.
3. Algemene voorwaarden van de consument worden uitdrukkelijk uitgesloten.

Artikel 4 – Het aanbod

1. Het aanbod bevat een duidelijke en volledige omschrijving van de producten.
2. De ondernemer besteedt de grootst mogelijke zorg aan juiste productinformatie, ingrediënten en gebruiksadviezen.
3. Kennelijke fouten of vergissingen in het aanbod binden de ondernemer niet.
4. Afbeeldingen dienen ter illustratie en kunnen afwijken van het daadwerkelijke product.

Artikel 5 – De overeenkomst

1. De overeenkomst komt tot stand op het moment dat de consument de bestelling afrondt en betaling heeft verricht.
2. Na het plaatsen van de bestelling ontvangt de consument een bevestiging per e-mail.

Artikel 6 – Prijzen

1. Alle prijzen zijn inclusief btw en exclusief verzendkosten, tenzij anders vermeld.
2. Verzendkosten worden duidelijk weergegeven vóór het afronden van de bestelling.
3. Prijswijzigingen hebben geen invloed op reeds gesloten overeenkomsten.

Artikel 7 – Betaling

1. Betaling dient te geschieden via de betaalmethoden die in de webshop worden aangeboden.
2. Indien betaling uitblijft, is de ondernemer gerechtigd de bestelling te annuleren.

Artikel 8 – Levering

1. Levering vindt plaats op het door de consument opgegeven adres binnen Nederland, de Europese Unie en daarbuiten, tenzij anders vermeld in de webshop.
2. De ondernemer streeft naar levering binnen 10 werkdagen.
3. Indien levering vertraging oploopt, wordt de consument hierover geïnformeerd.
4. Het risico van beschadiging of vermissing gaat over op de consument op het moment van levering.
5. Bij levering buiten de Europese Unie kunnen douanerechten, invoerbelastingen en lokale heffingen van toepassing zijn. Deze kosten zijn volledig voor rekening van de consument en zijn niet inbegrepen in de prijs of verzendkosten van de webshop.
6. De ondernemer heeft geen invloed op deze kosten en kan deze niet vooraf specificeren.
7. Voor leveringen buiten de Europese Unie gelden indicatieve levertijden. Vertragingen als gevolg van douanecontroles of lokale vervoerders geven geen recht op schadevergoeding.

 

Artikel 9 – Herroepingsrecht

1. De consument heeft het recht de overeenkomst binnen 14 dagen na ontvangst zonder opgave van redenen te herroepen.
2. Tijdens de bedenktijd dient de consument zorgvuldig om te gaan met het product en de verpakking.
3. Het product mag slechts worden uitgepakt of gebruikt voor zover nodig om de aard, kenmerken en werking vast te stellen.
4. De kosten voor retourzending zijn voor rekening van de consument, tenzij anders vermeld.

 

 

 

Artikel 10 – Uitsluiting herroepingsrecht (beautyproducten)

Het herroepingsrecht is uitgesloten voor:

1. Hygiënische en cosmetische producten waarvan de verzegeling is verbroken;
2. Producten die om redenen van gezondheidsbescherming niet kunnen worden geretourneerd;
3. Producten die duidelijk gebruikt zijn.
4. Producten die buiten de Europese Unie zijn verzonden en waarvan de verzegeling is verbroken, komen nimmer in aanmerking voor retour of terugbetaling.

Artikel 11 – Retourprocedure

1. Retouren dienen vooraf aangemeld te worden via theradiantrenaissance@gmail.com.
2. Het product dient ongebruikt, onbeschadigd en indien mogelijk in originele verpakking te worden geretourneerd.
3. Na correcte ontvangst wordt het aankoopbedrag binnen 14 dagen terugbetaald.
4. Bij retourzendingen vanuit landen buiten de Europese Unie zijn alle verzendkosten, douanekosten en invoerrechten volledig voor rekening van de consument.

Artikel 12 – Garantie en conformiteit

1. De ondernemer staat ervoor in dat de producten voldoen aan de overeenkomst en aan redelijke eisen van deugdelijkheid.
2. Eventuele gebreken dienen binnen een redelijke termijn na ontdekking gemeld te worden.
3. Garantie vervalt bij onjuist of oneigenlijk gebruik van het product.

Artikel 13 – Aansprakelijkheid

1. De ondernemer is niet aansprakelijk voor schade ontstaan door verkeerd gebruik van beautyproducten.
2. De aansprakelijkheid van de ondernemer is beperkt tot het bedrag van de bestelling.
3. De ondernemer is niet aansprakelijk voor indirecte schade, waaronder gevolgschade.

Artikel 14 – Overmacht

In geval van overmacht is de ondernemer gerechtigd de overeenkomst op te schorten of te ontbinden zonder schadevergoeding.

Artikel 15 – Intellectueel eigendom

Alle rechten van intellectuele eigendom met betrekking tot de webshop, teksten, afbeeldingen en producten berusten bij de ondernemer.

 

 

Artikel 16 – Toepasselijk recht en geschillen

1. Op alle overeenkomsten is Nederlands recht van toepassing.
2. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland.

Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

• Entrepreneur: The Radiant Renaissance, located at Schinkelkade 23 A-H, 1075 VH, Amsterdam, The Netherlands, registered with the Chamber of Commerce under number 99211327.
• Consumer: the natural person who is not acting in the course of a profession or business.
• Webshop: the online store of the Entrepreneur.
• Products: all physical beauty and personal care products offered for sale via the webshop.
• Agreement: the distance contract concluded between the Entrepreneur and the Consumer.

Article 3 – Applicability

1. These Terms & Conditions apply to every offer made by the Entrepreneur and to every Agreement concluded via the webshop.
2. Deviations from these Terms & Conditions are only valid if agreed upon in writing.
3. Any general terms and conditions used by the Consumer are expressly excluded.

Article 4 – The Offer

1. The offer contains a clear and complete description of the Products.
2. The Entrepreneur takes the greatest possible care in providing accurate product information, ingredients, and usage instructions.
3. Obvious errors or mistakes in the offer are not binding on the Entrepreneur.
4. Images are for illustrative purposes only and may differ from the actual Product.

Article 5 – The Agreement

1. The Agreement is concluded at the moment the Consumer completes the order and payment has been successfully processed.
2. After placing an order, the Consumer will receive an order confirmation by email.

Article 6 – Prices

1. All prices include VAT and exclude shipping costs, unless stated otherwise.
2. Shipping costs are clearly displayed before the order is finalized.
3. Price changes do not affect Agreements already concluded.

Article 7 – Payment

1. Payment must be made using one of the payment methods offered in the webshop.
2. If payment is not received, the Entrepreneur is entitled to cancel the order.

Article 8 – Delivery

1. Delivery takes place at the address provided by the Consumer within the Netherlands, the European Union, and internationally, unless stated otherwise in the webshop.
2. The Entrepreneur aims to deliver orders within 10 business days.
3. In the event of delivery delays, the Consumer will be informed accordingly.
4. The risk of damage or loss of Products transfers to the Consumer at the moment of delivery.
5. For deliveries outside the European Union, customs duties, import taxes, and local charges may apply. These costs are entirely at the Consumer’s expense and are not included in the Product price or shipping costs.
6. The Entrepreneur has no control over these charges and cannot estimate them in advance.
7. Delivery times for shipments outside the European Union are indicative. Delays caused by customs inspections or local carriers do not entitle the Consumer to compensation.

Article 9 – Right of Withdrawal

1. The Consumer has the right to withdraw from the Agreement within 14 days after receiving the Product, without stating any reason.
2. During the withdrawal period, the Consumer shall handle the Product and its packaging with care.
3. The Product may only be unpacked or used to the extent necessary to determine its nature, characteristics, and functioning.
4. Return shipping costs are borne by the Consumer, unless stated otherwise.

Article 10 – Exclusion of the Right of Withdrawal (Beauty Products)

The right of withdrawal is excluded for:

1. Hygienic and cosmetic Products where the seal has been broken;
2. Products that cannot be returned for reasons of health protection;
3. Products that are clearly used;
4. Products shipped outside the European Union for which the seal has been broken — these are never eligible for return or refund.

Article 11 – Return Procedure

1. Returns must be registered in advance via theradiantrenaissance@gmail.com.
2. Products must be returned unused, undamaged, and where possible in their original packaging.
3. After correct receipt of an approved return, the purchase amount will be refunded within 14 days.
4. For returns from countries outside the European Union, all shipping costs, customs fees, and import duties are entirely at the Consumer’s expense.

Article 12 – Warranty and Conformity

1. The Entrepreneur guarantees that the Products comply with the Agreement and meet reasonable standards of quality and usability.
2. Any defects must be reported within a reasonable period after discovery.
3. The warranty becomes void in the event of incorrect or improper use of the Product.

Article 13 – Liability

1. The Entrepreneur is not liable for damage resulting from incorrect use of beauty Products.
2. The Entrepreneur’s liability is limited to the amount paid for the order.
3. The Entrepreneur is not liable for indirect damage, including consequential damage.

Article 14 – Force Majeure

In the event of force majeure, the Entrepreneur is entitled to suspend or terminate the Agreement without any obligation to pay compensation.

Article 15 – Intellectual Property

All intellectual property rights relating to the webshop, texts, images, and Products are vested exclusively in the Entrepreneur.

Article 16 – Applicable Law and Disputes

1. All Agreements are governed by Dutch law.
2. Any disputes shall be submitted to the competent court in the Netherlands.

   We hanteren een retourbeleid van 30 dagen. Dit betekent dat je na ontvangst van je artikel 30 dagen de tijd hebt om een retour aan te vragen.
